General Terms and Conditions (GTC)
1. Scope and Contracting Parties
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB - German Civil Code) via the online shop www.queenofspadesstore.de.

1.3 Deviating or conflicting conditions of the customer are not recognised unless the seller expressly agrees to their validity in writing.
2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation for the customer to submit an offer.
2.2 By submitting the order via the button "Buy now", the customer makes a binding offer to purchase the goods contained in the shopping cart.
2.3 The purchase contract is concluded when the seller accepts the order by means of an order confirmation sent via email.
3. Prices and Payment Terms
3.1 All prices are final prices in Euro. According to § 19 UStG (German Turnover Tax Act), no sales tax is shown (small business regulation).
3.2 The available payment methods will be displayed during the ordering process (e.g., prepayment, PayPal, credit card).
3.3 If prepayment is selected as the payment method, the bank details will be communicated with the order confirmation. Delivery will take place after receipt of payment.
4. Delivery and Shipping
4.1 Delivery takes place within Germany and to member states of the European Union.
4.2 Shipping costs are clearly indicated during the ordering process. Shipping may be free of charge above a certain order value; the conditions can be viewed on the website.
4.3 The delivery time is generally 5 to 12 working days after receipt of payment, unless a different delivery time is specified for the product.
4.4 If an item is not available, the customer will be informed immediately. Any payments already made will be refunded without delay.
5. Delivery Restrictions and Customs Information
5.1 Some products are manufactured and shipped directly by international production or logistics partners. In these cases, shipping may occur from a third country (e.g., China, USA, or Great Britain).
5.2 For deliveries from third countries, customs duties, import duties, or taxes may apply, which are to be borne by the customer. The amount of these charges depends on the regulations of the respective country of residence.
5.3 It will be indicated on the product pages if an item is shipped from abroad. Delivery time may vary depending on the country of origin and shipping service provider.
6. Right of Withdrawal
6.1 Consumers generally have a right of withdrawal according to § 355 BGB (German Civil Code).
6.2 The right of withdrawal does not apply to contracts for the supply of goods that are custom-made or clearly tailored to personal needs (§ 312g para. 2 no. 1 BGB). This applies in particular to personalized print-on-demand items (e.g., products with individual text, name, design, or date).
6.3 Otherwise, the cancellation policy available on the website in its current version applies.
6.4 The customer bears the costs of returning the goods in the event of withdrawal, unless a different agreement has been made.
7. Retention of Title
The delivered goods remain the property of the seller until full payment has been received.
8. Warranty and Liability
8.1 The statutory warranty rights (§§ 434 ff. BGB) apply.
8.2 The seller's liability for slightly negligent breaches of duty is excluded, unless essential contractual obligations (cardinal obligations) are affected. In this case, liability is limited to the foreseeable damage typical for the contract.
8.3 Liability under the Product Liability Act and for damages resulting from injury to life, body or health remains unaffected.
9. Data Protection
9.1 Customers' personal data will be processed exclusively within the framework of applicable data protection laws.
9.2 Further information can be found in the privacy policy published on the website.
10. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Note: The former EU Online Dispute Resolution Platform was discontinued on July 20, 2025.
11. Final Provisions
11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
11.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the seller's registered office.
11.3 Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions remains unaffected.
